The online services provided by PixLab, a service by Symisc Systems, SUARL, are governed by the terms and conditions outlined below ("this Agreement"). This page explains the terms under which you may access and use our Cloud Services, Websites, Online Applications, APIs, and Software Development Kit (SDK) (collectively referred to as the "Service(s)"). Your acceptance of this Agreement may be indicated in several ways, including signing a document agreeing to these terms, clicking a button or checkbox confirming acceptance, or by continuing to use the Services. Any of these actions will constitute your agreement to and acceptance of the terms outlined in this Agreement.

Agreement to Terms

  • By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please discontinue your use of the PixLab Websites, SDKs, and APIs immediately.
  • IMPORTANT NOTICE REGARDING ARBITRATION:
  • BY AGREEING TO THESE TERMS, YOU AGREE (WITH LIMITED EXCEPTION) TO RESOLVE ANY DISPUTE BETWEEN YOU AND PIXLAB | SYMISC SYSTEMS THROUGH BINDING, INDIVIDUAL ARBITRATION RATHER THAN IN COURT. PLEASE REVIEW THE SECTION TITLED “DISPUTE RESOLUTION FOR CONSUMERS” BELOW CAREFULLY FOR DETAILS ON ARBITRATION, INCLUDING INSTRUCTIONS FOR OPTING OUT.
  • Your issued API key is the only binding agreement between you and PixLab. No additional legal guarantees or obligations apply beyond our published Terms of Service and Privacy Policy.

Changes to Terms or Services

We reserve the right to modify the Services and update these Terms at any time and at our sole discretion. We will notify you of any changes by posting the updated Terms on the Services or through other communications. Your continued use of the Services constitutes acceptance of the updated Terms. It is your responsibility to review the Terms periodically to remain informed of any modifications. If you do not agree to the updated Terms, you must discontinue your use of the Services. We may, at any time and at our sole discretion, change, suspend, or discontinue any part of the Services, or restrict access to any portion of the Services, without prior notice.

Privacy Policy

We are committed to protecting the privacy of our users. PixLab will not disclose your personal information to any third party without your explicit consent. By utilizing the Services, you acknowledge and agree to the collection of your personally identifiable information and aggregate data as outlined in our Privacy Policy, and you consent to the processing of your information in accordance with its terms.

Data Residency (EU Region)

  • For customers in the EU region with data residency or compliance requirements, PixLab offers the ability to deploy a private compute instance hosted in the European Union (France or Germany). Each private instance is assigned its own API subdomain (e.g., yourorg.api.pixlab.io), ensuring traffic is localized and infrastructure is isolated thus complying with EU GDPR regulations ensuring data stays within the EU.
  • To comply with GDPR, all uploaded ID document images are processed directly in memory (RAM) and purged immediately after analysis. PixLab does not retain any image or extracted data unless you explicitly configure it to export face crops or metadata to your private AWS S3 bucket.
  • This architecture ensures maximum privacy and eliminates long-term retention of any personally identifiable information by default.

Use of Services

PixLab provides advanced artificial intelligence algorithms and tools for processing and analyzing images, videos, and other types of data. We focus on machine learning daily and are thrilled to share this cutting-edge technology with you!

Eligibility

You may use the Service only if you are legally capable of forming a binding contract with PixLab and comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations. Use or access to the Service by individuals under the age of 13 is strictly prohibited and constitutes a violation of this Agreement.

Service

Subject to the terms and conditions of this Agreement, you are granted a non-exclusive, limited, non-transferable, and freely revocable license to use the Service for personal, non-commercial purposes, as permitted by the features of the Service. PixLab retains all rights not expressly granted in this Agreement regarding the Service and PixLab Content (as defined below). PixLab reserves the right to terminate this license at any time, with or without cause.

Accounts

Your PixLab account gives you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. We may maintain different types of accounts for different types of Users. If you open a PixLab account on behalf of a company, organization, or other entity, then (a) “you” includes you and that entity, and (b) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity’s behalf. By connecting to PixLab with a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.

You may never use another User’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. PixLab will automatically generate a strong password for you when you sign-up for an account and your are free to change that password from your dashboard once you login with the given credentials. You must notify PixLab immediately of any breach of security or unauthorized use of your account.

PixLab will not be liable for any losses caused by any unauthorized use of your account. By providing PixLab your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers.

Service Rules

You agree not to engage in any of the following prohibited activities:

  • Copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated “scraping”.
  • Using any automated system, including without limitation “robots,” “spiders,” “offline readers,” “bots,” etc., to access the Service in a manner that sends more request messages to the PixLab servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (except that PixLab grants the operators of public search engines revocable permission to use spiders to copy materials from pixlab.io for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials).
  • Transmitting spam, chain letters, or other unsolicited email.
  • Attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service.
  • Taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure.
  • Uploading invalid data, viruses, worms, or other software agents through the Service.
  • Collecting or harvesting any personally identifiable information, including account names, from the Service.
  • Using the Service for any commercial solicitation purposes.
  • Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity.
  • Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Service or Content.
  • Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Service or Content to send altered, deceptive or false source-identifying information.
  • Interfering with the proper working of the Service.
  • Accessing any content on the Service through any technology or means other than those provided or authorized by the Service.
  • Bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.

We may, without prior notice, change the Service; stop providing the Service or features of the Service, to you or to users generally; or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if in our sole determination you violate any provision of this Agreement, or for no reason. Upon termination for any reason or no reason, you continue to be bound by this Agreement.

You are solely responsible for your interactions with other PixLab Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users. PixLab shall have no liability for your interactions with other Users, or for any User’s action or inaction.

Service Level Agreements (SLA)

Service Level Agreements (SLAs) are not included in standard plans. However, enterprise-level clients and those with critical business needs may request a customized 99.9% SLA uptime guarantee with PixLab | Symisc Systems ↗. Refer to the PixLab Console ↗ for additional information. SLA Offerings for Enterprise Customers includes:

  • Guaranteed 99.9% Uptime: Available for enterprise customers upon request.
  • Priority Support & Dedicated Resources: Faster response times and technical assistance.
  • Custom Agreements: Negotiable terms tailored to business-specific needs.

Streamlined Service Rules

To ensure fair use and security for all customers, the following activities are strictly prohibited:

  • Excessive or abusive traffic load without prior agreement
  • Automated scraping or bulk re-querying of API endpoints
  • Attempting to reverse engineer or probe internal model behavior
  • Any activity intended to compromise service availability or integrity

Terms of Use for Downloadable Software Available on this Website

Any software that is made available to download from this server ("Software") is the copyrighted work of Symisc Systems, Inc. and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). An end user will be unable to install any Software that is accompanied by or includes a License Agreement, unless he or she first agrees to the License Agreement terms. The Software is made available for downloading solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED.

THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, SYMISC SYSTEMS, INC. HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT

Terms of Use for Documents Available on this Website. Permission to use Documents (such as white papers, press releases, datasheets and FAQs) from this server ("Server") is granted, provided that: (1) the below copyright notice appears in all copies and that both the copyright notice and this permission notice appear. IN NO EVENT SHALL SYMISC SYSTEMS AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF INFORMATION AVAILABLE FROM THIS SERVER.

Proprietary Rights

Except for your Own Content, the Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and User Content belonging to other Users (the “PixLab Content”), and all Intellectual Property Rights related thereto, are the exclusive property of PixLab and its licensors (including other Users who post User Content to the Service). Except as explicitly provided herein, nothing in this Agreement shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any PixLab Content. Use of the PixLab Content for any purpose not expressly permitted by this Agreement is strictly prohibited.

You may choose to or we may invite you to submit comments or ideas about the Service, including without limitation about how to improve the Service. By submitting any Idea, you agree that your disclosure is gratuitous, unsolicited and without restriction and will not place PixLab under any fiduciary or other obligation, and that we are free to use the Idea without any additional compensation to you, and/or to disclose the Idea on a non-confidential basis or otherwise to anyone. You further acknowledge that, by acceptance of your submission, PixLab does not waive any rights to use similar or related ideas previously known to PixLab, or developed by its employees, or obtained from sources other than you.

Refund Policy

  • We provide a complete money-back guarantee for all PixLab's Plans. If you are dissatisfied with the plan you subscribed to, you can receive a refund with no questions asked. You are eligible for a full reimbursement within 14 calendar days of purchase. Beyond this 14-day period, refunds are no longer available.
  • We encourage customers to take advantage of our free trials within the first weeks to ensure that the chosen plan meets their needs.
  • If PixLab | Symisc Systems suspends or terminates your account or this Agreement, please note that you are not entitled to any refund or exchange for any PixLab | Symisc Systems property, any unused subscription time, any fees associated with licenses or subscriptions, any account-related content or data, or any other items.

Subscription, Billing & Payment Processing

  • Pricing Context: Certain aspects of the Service may be provided for a fee or other monthly recurring charges. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms, as we may update them from time to time. PixLab | Symisc Systems may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall become effective in the billing cycle following notice of such change to you as provided in this Agreement.
  • Merchant of Records: Our order process is conducted by our online reseller Paddle. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
  • Payment Processing: PixLab | Symisc Systems does not store your credit card details or even know anything about them. Subscription & Billing are 100% handled by our merchant of records (MoR) Paddle which is PCI & GDPR compliant and, a platform of trust. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

PixLab Property

Certain aspects of the Service may allow you to obtain certain reputation or status indicators (“PixLab Property”). You understand and agree that regardless of terminology used, PixLab Property represents a limited license right governed solely by the terms of this Agreement and available for distribution at PixLab’s sole discretion. PixLab Property is not redeemable for any sum of money or monetary value from PixLab at any time. You acknowledge that you do not own the account you use to access the Service, nor do you possess any rights of access or rights to data stored by or on behalf of PixLab on PixLab servers, including without limitation any data representing or embodying any or all of your PixLab Property. You agree that PixLab has the absolute right to manage, regulate, control, modify and/or eliminate PixLab Property as it sees fit in its sole discretion, in any general or specific case, and that PixLab will have no liability to you based on its exercise of such right. All data on PixLab’s servers are subject to deletion, alteration or transfer.

NOTWITHSTANDING ANY VALUE ATTRIBUTED TO SUCH DATA BY YOU OR ANY THIRD PARTY, YOU UNDERSTAND AND AGREE THAT ANY DATA, ACCOUNT HISTORY AND ACCOUNT CONTENT RESIDING ON COMPANY’S SERVERS, MAY BE DELETED, ALTERED, MOVED OR TRANSFERRED AT ANY TIME FOR ANY REASON IN COMPANY’S SOLE DISCRETION, WITH OR WITHOUT NOTICE AND WITH NO LIABILITY OF ANY KIND. COMPANY DOES NOT PROVIDE OR GUARANTEE, AND EXPRESSLY DISCLAIMS, ANY VALUE, CASH OR OTHERWISE, ATTRIBUTED TO ANY DATA RESIDING ON COMPANY’S SERVERS.

Indemnity

You agree to indemnify and hold harmless PixLab | SYMISC SYSTEMS and its officers, directors, employees, and agents from and against any and all claims, disputes, demands, liabilities, damages, losses, costs, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your breach of these Terms.

Warranty Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, THE COMPANY, ITS SUBSIDIARIES, AFFILIATES, AND LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE, OR CORRECT; THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED, OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DOWNLOADED AT YOUR OWN RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE, OR LOSS OF DATA THAT RESULTS FROM SUCH DOWNLOAD OR YOUR USE OF THE SERVICE.
THE COMPANY DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE COMPANY SERVICE OR ANY HYPERLINKED WEBSITE OR SERVICE, AND THE COMPANY WILL NOT BE A PARTY TO OR IN ANY WAY MONITOR ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Governing Law and Forum Choice

This Agreement shall be governed, interpreted and construed under the laws of the Republic of Tunisia without regard to its conflict of law principles. The parties agree that any dispute or litigation arising in whole or in part hereunder shall, at the option of the Corporation, be litigated in any court of competent subject matter jurisdiction sitting in Tunisia, to the jurisdiction of which and venue in which Executive irrevocably consents.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. UNDER NO CIRCUMSTANCES WILL THE COMPANY BE LIABLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL LIABILITY AND RESPONSIBILITY FOR (I) ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY BY JURISDICTION. General Terms

These Terms and Conditions govern the relationship between you and PixLab | Symisc Systems and constitute the entire understanding regarding the subject matter.

  • Entire Agreement: These Terms, along with any documents referenced or incorporated herein, constitute the complete and exclusive understanding and agreement between PixLab | Symisc Systems and you concerning the Websites and their Content. These Terms supersede all prior oral or written understandings or agreements between PixLab | Symisc Systems and you regarding the Services and Content. If any provision of these Terms is deemed invalid or unenforceable by an arbitrator or a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. You may not assign or transfer these Terms, whether by operation of law or otherwise, without the prior written consent of PixLab | Symisc Systems.   • Notices: Any notices or other communications provided by PixLab | Symisc Systems under these Terms, including those regarding modifications to these Terms, will be delivered: (i) via email; or (ii) by posting on the Websites. For notices delivered via email, the date of receipt will be considered the date on which such notice is transmitted.
  • Waiver of Rights: The failure of PixLab | Symisc Systems to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. The waiver of any such right or provision shall be effective only if in writing and signed by a duly authorized representative of PixLab | Symisc Systems. Except as expressly stated in these Terms, the exercise by either party of any of its remedies under these Terms shall be without prejudice to its other remedies under these Terms or otherwise.
